Terms and Conditions (T&C) - Elconel Consulting

I. Basic Provisions

These General Terms and Conditions ("GTC") govern the contractual relationship between Elconel UG (VAT ID: DE350786748, Company No.: HRB-256057B, Stresemannstr. 12, 10693 Berlin, Germany), hereinafter referred to as "Elconel UG", and its customers ("Buyer").

The Buyer may be either a consumer or a business entity.

A consumer is an individual who enters into a contract outside the scope of their business or professional activity.

A business entity is any person or organization conducting business with the intention of profit.

By placing an order, the Buyer acknowledges having read and accepted these GTC in the version valid at the time of the order.

II. Pre-Contractual Information

The Buyer has the right to withdraw from a purchase contract:

within 14 days of receiving the goods,

or in the case of multiple deliveries, from the date of the last delivery.

Withdrawal must be sent to the official address of Elconel UG.

The right of withdrawal does not apply to:

custom-made or perishable goods,

sealed goods opened after delivery for hygiene reasons,

digital content or services already fulfilled with consent before withdrawal deadline.

III. Contract Formation & Fulfillment

Orders may be placed via the Elconel UG website or by email. The contract is concluded upon confirmation of the order.

Elconel UG retains ownership until full payment is received. The risk of damage transfers to the Buyer upon receipt of the goods.

IV. Liability for Defects

Elconel UG warrants that the goods:

match the agreed description,

are suitable for their intended purpose,

comply with legal requirements.

For consumers, the defect liability period is 24 months from receipt.

For businesses, it may differ based on product type and agreement.

V. Warranty & Claims

In case of significant defects, the Buyer may request:

a replacement or repair,

a price reduction,

or a contract withdrawal.

Claims for visible defects must be reported immediately upon delivery. Hidden defects must be reported within two years.

VI. Pricing and Payment

All prices include VAT unless otherwise specified. Errors in pricing may result in cancellation of the contract.

Accepted payment methods include:

Bank transfer

Credit card (Visa/MasterCard)

PayPal

Klarna

VII. Delivery

Delivery is made via courier or logistics service.

Buyers must inspect goods upon receipt and report any discrepancies or damage immediately.

VIII. Data Protection

Elconel UG processes personal data solely for contract fulfillment and marketing within legal boundaries.

Data will not be shared with third parties except for delivery or payment processing.

IX. Final Provisions

These GTC are valid from 01.09.2022.

Contracts are concluded in German; the German version shall prevail in the event of interpretation disputes.
